We commit to protecting the privacy of the information you supply to us. Eventride, (“Eventride“, “we” or “us“) and our users will abide by the terms of policy. This privacy policy (the “Privacy Policy“) is intended to help you understand how we collect, use, and disclose your information.

 

User Consent

 

By submitting Information through our services, you expressly consent to the processing of your Information according to this Privacy Policy. Your Information may be processed by us in the country where it was collected as well as other countries (including Canada and the United States) where laws regarding processing of Information may be less stringent than laws in your country.

 

The Information Collected

 

You may have accessed Eventride by visiting http://www.Eventride.com, by using our mobile application, or through the site of one of our third-party partners with whom we have teamed to provide ride matching services (collectively, the “Services“), such as an Eventride co-branding partner or a corporate partner (collectively, “Partners“). This notice applies to all information you submit to Eventride through the Services. Please note that we cannot be responsible for the information you submit directly to third parties, including our Partners, who may have their own posted policies regarding the collection, use, and disclosure of your information. We urge you to review the policies of our Partners (Such as Facebook) through whom you may access our services.

 

The types of information, including without limitation personal information (“Information“) we may collect from users through the Services are:

Comments and feedback about volunteer experiences

Credit Card Information (Not stored, Stripe fulfilled)

HOW WE USE INFORMATION

 

We do not sell, rent, or trade our user Information to outside parties. We use the Information we collect about you to provide and improve the Services, recommend relevant Eventride ride matches to events, respond to your requests, and maintain your file, and process carbon offsets.

Please be aware that, to the extent required to provide our services, we share your Information with matched users, our third-party service providers, or our Partners, as applicable. We may use our email lists for sending out Eventride outbound communications. We also reserve the right to use your Information to send you transactional e-mails, and you cannot opt out of receiving transactional e-mails without deleting your account by emailing info@eventride.com

 

THIRD-PARTY ACCESS AND USE

 

Occasionally, we or our Partners, use third-party service providers to help provide or improve the services we offer you. Sometimes these providers have access to the Information we collect about you as a part of providing, maintaining, and improving the Services. WE ONLY SUPPLY YOUR CREDIT CARD INFORMATION TO STRIPE for the purpose of transacting the Service, and no other Third Parties.

 

We share aggregate information about our users with certain third parties. This information shows user activity at a group level, rather than on an individual basis.

 

In the event that Eventride undergoes a sale or transfer of all or substantially all of its assets, the acquiring entity may use your Information subject to this Privacy Policy. In addition, in the further unlikely event that Eventride is adjudicated bankrupt or insolvent (a) there will be no further use or disclosure of your personally identifiable Information by Eventride and (b) reasonable efforts will be taken to ensure your personally identifiable Information on Eventride’s servers will be destroyed. In addition, there will be no use or disclosure of your personally identifiable Information by any entity that acquires assets of Eventride pursuant to such bankruptcy or insolvency proceedings.

Due to factors beyond our control, however, we cannot fully ensure that your Information will not be disclosed to third parties. For example, we may be legally obligated to disclose Information to the government or third parties under certain circumstances, or third parties may circumvent our security measures to unlawfully intercept or access your Personal Information.

The Services contain links to other third-party sites and applications such as Facebook. Eventride is not responsible for the privacy practices or the content of such third-party sites and applications.

 

REVIEW OR CORRECT YOUR INFORMATION

 

If you are a User with a personal Eventride account (either through our Application, or a Partner’s Web site) you may review and make changes to all of your Information that we collect and maintain online by simply inputting your username and password where indicated on the applicable Service.

If you are a user with a personal Eventride account, once you login in, you may make any changes or correct factual errors in your account by changing the information on your login page. This option is available to better safeguard your Information, subject to downtime for standard maintenance and support. You do not need to contact us to access your record or to make any changes. If you have problems changing your Information, please contact us at info@eventride.com

 

DATA SECURITY

 

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of Information, we have put in place significant physical, electronic, and managerial procedures in an effort to safeguard and secure the Information we collect online as per PCI Standards. POLICY Changes

 

This Privacy Policy is subject to occasional revision. If we make any changes to this Privacy Policy, we will change the “Effective Date” above.

An Eventride carpool match between two users will see the amount set by the Driver have an additional 13% and 0.30 cents added to the amount paid by the Rider.  Any Driver that sets a price of zero dollars will not have any additional fees added and the Rider will require no payment for that ride.

Item Return Policy.

Any Eventride carpool match between two users that is deemed to have been not fulfilled with see the full amount paid to the Rider.  Any Eventride carpool match between two users that is disputed will be put on hold and placed into resolution analysis with the possible outcome being a full return of monies paid to the Rider.

TERMS OF SERVICE FOR EVENTRIDE – May 5th, 2016

 

 

Terms of Service

 

These terms of service (the “Agreement”) govern the relationship between the User (“you” or “your” or “user”) and Eventride (“Eventride” or “us” or “we”) regarding your use of Eventride™ service and all related services (collectively, the “Service”). By creating an account with us or accessing or using the Service you accept and agree to be bound by the terms and conditions of the Agreement. If you do not agree with any of the terms of the Agreement, do not use or access the Service.

 

  1. SPECIAL TERMS GOVERNING THE USE OF THE ANDROID and IOS RELEASE:

THE SERVICE IS CURRENTLY PROVIDED TO YOU AS A Version 1 RELEASE. TO THE FULLEST EXTENT PERMITTED BY LAW, SUCH Version 1 RELEASE IS PROVIDED TO YOU “AS IS” AND AT YOUR OPTION AND RISK. DURING THE Version 1 PHASE EVENTRIDE MAY MODIFY, CHANGE, DISABLE THE SERVICE AT ANY TIME WITHOUT PRIOR NOTICE. THESE SPECIAL TERMS OVERRIDE ANY CONFLICTING TERMS IN THIS AGREEMENT.

 

  1. USER ACCOUNTS

2.1.      Registration

In order to use the Service you must sign up for an account. We retain all rights to your username and other account credentials with the right to amend them in such manner as we deem appropriate from time to time. Usernames that are deemed inappropriate will be replaced by a random user name and/or delete from the Service. Users can use the Service as either a Driver or a Rider and agree to the obligations indicated in section 10.5

 

2.2.      Information

 

You may be required to input certain information in connection with registering for an account. Any information you provide us must be accurate and complete. If the information on your account changes or becomes inaccurate, it is your responsibility to inform us of same. Failure to inform us of changes to your account information may result in loss of Service privileges. Any information you provide us in connection with the Service will be kept confidential and handled in accordance with all applicable privacy laws, rules and regulations. You will be required to supply your Facebook credentials to the Service, including but no limited to your Friends list. You also consent to allowing the Service to show other Users who are interested in taking a Ride from you or Driver you to see your Facebook friends.

 

2.3.      Your Location and Eventride

 

The Service includes features and functionalities that utilize capabilities of certain mobile devices to locate you and are notified when said devices become proximate to you, and that share and publicise your location and Eventride within the Service to other users of the Service. You will be asked to consent to the use of your location within and in connection with the Service. Your location data will be stored and processed by us in accordance with all applicable laws, rules and regulations.

 

2.4.      Responsibility for Your Account

 

You are responsible for the information contained in your account. Please notify us immediately of any unauthorized activity on, or use of, your account.

 

  1. PROVISION AND USE OF THE SERVICE

3.1.      Provision of the Service

 

We are entitled to modify, amend, change or terminate the Service or any part of the Service. You are responsible for any fees, including mobile fees, that you may incur when accessing and using the Service.

 

3.2.      Availability of the Service

 

We shall use all reasonable commercial efforts to ensure that the Service is available to you continuously. However, we retain the right to suspend the Service, at any time, for any reason.

 

3.3.      Accepted Use of the Service

 

Use of the Service is subject to your continued compliance with the terms and conditions of the Agreement, all applicable laws, rules and regulations, and any other agreements that may be in place between you and us. Use of the Service is for non-commercial purposes only. The Service may not be resold or otherwise distributed.

 

3.4.      Third Party Information and Material in the Service

 

The Service may from time to time include bulleting boards and other features and functionalities that enable its users to upload and submit text and other content and information. We do not pre-screen, select, approve or monitor any third party material or information submitted to the Service. You are solely responsible for any material and information you submit to the Service and we do not take responsibility for any information, including information or material that may contain infringing or illegal content.

 

3.5.      Prohibited Uses of the Service

 

You shall not, and shall not authorize any third party to:

 

  • defame, abuse, harass, stalk, threaten or otherwise violate the privacy or legal rights of others users;
  • submit to or post on the Service any inappropriate, defamatory, infringing, obscene, indecent or unlawful material or information;
  • submit any material or information that is illegal or infringes on rights of a third party;
  • create a new account to use the Service after we have terminated the Agreement with you, in full or in part, as a result of your breach of the Agreement;
  • use your account to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk e-mail or repetitive messages (spim and spam) to anyone;
  • rent, lease, sell, trade, gift or otherwise transfer your account or any virtual items or virtual assets associated with your account to anyone without Eventride’s written permission;
  • use another user’s account;
  • modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Service or any related software; and
  • disrupt or interfere or attempt to disrupt or interfere with the Service in any way or in manner, or undermine or manipulate the legitimate operation of the Service.
  • Use our event data in any way other than scheduling rides through our service. Event data is supplied by Eventful Inc.
  1. SERVICE FEES; PAYMENT

The Service may from time to time include features, functionalities and content which are subject to payment of separate fees. Such fees are specified in the Service. We retain the right to amend the fees without notice to you. You agree to pay such fees to us, and you further agree that we may authorize third parties to charge and collect such fees on Eventride’s behalf. Additional terms and conditions of third parties may apply. By making payment to us, or any authorized third party, you represent and warrant that you have the authority to use your designated credit card or other payment method for the payment of the fees. All payments are final and non-refundable.

 

  1. DISCLAIMER

THE SERVICE IS PROVIDED “AS IS” AND WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AND WE DISCLAIM AND NEGATE ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS. FURTHER, WE DO NO WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, OR RELIABILITY, OF ANY OF THE INFORMATION OR MATERIAL THAT MAY APPEAR ON THE SERVICE.

 

  1. LIMITATION OF LIABILITY; FORCE MAJEURE

IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT), ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON THE SERVICE, EVEN IF WE HAVE BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

 

The parties to the Agreement, and each of them, acknowledge that the other party has entered into the Agreement relying on the limitations of liability stated herein. Without limiting the foregoing and except for payment obligations, neither party shall have any liability for any failure or delay resulting from any condition beyond the reasonable control of such party, including but not limited to acts of God, labour conditions, power failures and interruptions in communications connections.

 

  1. DATA SECURITY

We shall use all reasonable efforts to ensure data security of data systems related to the Service. However, we are not responsible for, nor do we assume any liability arising out of, data security breaches, including without limitation, costs, damages and losses related to unauthorised access to data by third parties or loss of data. Eventride may choose to supply meta-data analysis to its partners, stripped of personal user information.

 

  1. CHANGES TO THIS AGREEMENT; SUPPLEMENTAL POLICIES

We retain the right to, and may from time to time, change or modify the terms of the Agreement without notice. Any change or modification that we may make to the Agreement must be accepted by you before using the Service. In continuing to use the Service following any changes or modifications to the Agreement, you agree to be bound by the then current version of the Agreement.

 

We retain the right to, and may from time to time, publish additional policies and terms and conditions related to certain parts of the Service. Your right to use such parts of the Service is subject to the specific policies and terms and conditions related to such parts, and by using such parts, you agree to be bound by the additional policies and terms and conditions. Any additional policies or terms or conditions are in addition to, and do not limit, the Agreement.

 

  1. TERMINATION

You may terminate the Agreement, with or without cause, at any time with a notice period of five business days by sending written notice of your desire to cancel your participation in the Service to us. We may at any time, in Eventride’s sole discretion, terminate all or part of the Service or the Agreement for any reason, without notice to you. Upon termination the provision of the Service shall cease immediately. We retain the right to delete all data submitted by you upon termination.

 

  1. MISCELLANEOUS

10.1.    Jurisdiction

 

The Agreement shall be governed by, construed and enforced in accordance with the laws of the Manitoba, as it is applied to agreements entered into and to be performed entirely with such province. Any action you bring to enforce the Agreement shall be brought only in the courts of the Manitoba, and you expressly consent to the jurisdiction of said courts. If any provision of the Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing.

 

10.2. Performance and Breach

 

The failure to require performance of any term of the Agreement shall not affect a party’s right to require performance at any time thereafter, nor shall a waiver of any breach or default of the Agreement constitute a waiver of any subsequent breach or default or a waiver of the term itself.

 

10.3. Assignment

 

You may not resell, assign, or transfer any of your rights hereunder. Any such attempt may result in termination of the Agreement. We may assign the Agreement to any affiliate at any time without notice and otherwise as part of a sale of business.

 

 

10.4 Carbon Offset Release

 

You consent to forgo any ownership of the carbon offset that was created by the car trip you shared with another user of the Eventride Service. Eventride retains the right to supply this created offset to its Third Party partners, and or a civic government in the city the offset was created, or for any other use by Eventride.

 

10.5 Vehicle Operation

 

You agree and commit to only operating a vehicle that is properly insured with a valid personal driver’s license. You also consent to indemnifying from all liability Eventride and its partners including but not limited to the following sports leagues Major League Baseball, The National Football League, The National Basketball League, The National Hockey League, Major League Soccer, The Canadian Football League, etc. You agree to hold Eventride and its Partners Harmless for any accident you may get into or other liabilities you incur while using the Service either as a Driver or a Rider.

 

10.6 Additional Indemnification

 

You release Eventride for any damages or liabilities that come from usage of the Service (Eventride), and also indemnify all of Eventride’s Partners and Insurers. You also release and indemnify Eventride and its Partners from any violations of traffic codes or city or state variances related to the operation of a vehicle that is used in conjunction with the Service.

 

10.7 Not to be used as a Business

 

You commit to not using Eventride as personal business and only use the service to cover the expenses of a trip you would have taken regardless of the match to another Eventride user.

 

10.8 Not to be used by a Minor

Users of Eventride must be of the majority age of 18 years old in order to use the Service.  Anyone discovered to less than 18 years will have their access revoked.
